Service overview

Airproxy is a residential and datacenter proxy provider that allows users to access the internet through third-party IP addresses. The service is accessible from the website airproxy.store (hereinafter "the Platform").

These Terms of Use (hereinafter the "Terms") govern access to and use of the Platform as well as all associated services offered by Airproxy (hereinafter "the Provider").

By accessing the Platform or using any Airproxy service, the user acknowledges having read these Terms and accepts them without reservation.

Acceptance of the Terms

Use of the Platform implies full and unreserved acceptance of these Terms. This acceptance is established when an account is created, by ticking the box dedicated to accepting the Terms of Use and the Terms of Sale.

The user must be at least 18 years old, or have reached the age of legal majority in their country of residence, to use Airproxy services. By creating an account, the user declares that they meet this condition.

If the user uses the services in a professional capacity on behalf of a legal entity, they declare that they have the necessary authority to bind that entity.

Service access and registration

Access to certain services requires the creation of a user account. The user undertakes to:

  • Provide accurate, complete and up-to-date information when registering;
  • Keep their login credentials (email and password) confidential;
  • Immediately notify Airproxy of any unauthorized use of their account via support;
  • Not create multiple accounts without Airproxy's express authorization;
  • Not assign, rent or share their account with third parties.

Airproxy reserves the right to refuse registration or suspend an account without notice in the event of non-compliance with these Terms or fraudulent behavior.

The email address provided at registration must be valid and belong to the user. It serves as a unique identifier and is used for communications relating to the account.

Permitted uses

Airproxy services are made available exclusively for lawful uses. By way of non-exhaustive example, the following uses are permitted:

  • Anonymous internet browsing in compliance with applicable law;
  • Competitive intelligence and collection of public data in compliance with the terms of use of the target sites;
  • Testing and development of applications requiring multiple IP addresses;
  • Access to geo-restricted content that is legally available in the IP's country of origin;
  • Automation of lawful tasks on third-party services with their consent.

The user is solely responsible for their use of the proxies and for the compliance of their activities with the laws of their country of residence as well as those of the countries affected by their activities.

Prohibited uses
Any unlawful use of Airproxy proxies is strictly prohibited and will result in the immediate suspension of the account and, where applicable, a report to the competent authorities.

In particular, it is prohibited to use Airproxy services to:

  • Carry out any illegal activity or activity contrary to applicable regulations (fraud, scams, money laundering, etc.);
  • Send unsolicited messages (spam) in volume or in an abusive manner;
  • Conduct cyberattacks (DDoS, intrusion, vulnerability scanning, etc.);
  • Impersonate an identity or fraudulently access an information system;
  • Distribute unlawful content (child sexual abuse material, incitement to hatred, terrorism, etc.);
  • Bypass protection or access-control systems without authorization;
  • Infringe the intellectual property rights of third parties;
  • Carry out mass data scraping in violation of the terms of use of target sites or applicable regulations;
  • Conduct phishing or social engineering activities;
  • Engage in any activity that infringes the rights of others or public order.

Airproxy will fully cooperate with the competent judicial authorities in the event of an investigation into unlawful activities carried out through its services.

Liability

User's liability: The user is entirely and solely responsible for their use of Airproxy services. They shall indemnify Airproxy against any claim, lawsuit or conviction that may result from use not compliant with these Terms or with the law.

Airproxy's liability: Airproxy undertakes to implement all reasonable means to ensure the availability and quality of its services. However, Airproxy cannot be held liable for:

  • Service interruptions due to third parties, force majeure events or scheduled maintenance;
  • The direct or indirect consequences of the user's use of the proxies;
  • Loss of data or corruption of files related to use of the service;
  • Indirect damage, loss of profit or loss of clientele suffered by the user;
  • The behavior or policies of third-party sites accessed via the proxies.

In any event, Airproxy's liability shall not exceed the total amount of the sums actually paid by the user during the three (3) months preceding the triggering event.

Availability and maintenance

Airproxy strives to ensure a service availability rate of 99.99% on a monthly basis, excluding scheduled maintenance periods.

Interruptions may occur, in particular in the following cases:

  • Preventive or corrective maintenance, announced where possible with reasonable advance notice;
  • Unforeseeable technical incidents affecting the infrastructure or access providers;
  • Force majeure events (natural disasters, conflicts, widespread outages, etc.).

The validity period of purchased proxies is the one indicated at the time of purchase and takes effect from delivery. No automatic renewal is applied.

Intellectual property

All elements making up the Airproxy Platform (source code, design, logos, texts, trademarks, etc.) are protected by intellectual property laws and are the exclusive property of Airproxy or its partners.

Any reproduction, representation, modification, publication or adaptation, in whole or in part, of these elements, without the prior written authorization of Airproxy, is strictly prohibited and would constitute infringement.

Access to the Platform does not grant the user any intellectual property rights over the elements that compose it.

Personal data (GDPR)

Airproxy processes users' personal data in accordance with the General Data Protection Regulation (GDPR - EU 2016/679) and applicable French law.

Data collected: email address, connection data (logs), payment information (processed directly by secure third-party providers), and service usage data.

Purposes: account management, service performance, billing, fraud prevention, service improvement, legal obligations.

Legal basis: contractual performance, legal obligations, Airproxy's legitimate interests.

Retention: data is kept for the duration of the contractual relationship and the applicable legal periods (5 years for billing data).

Rights: in accordance with the GDPR, the user has a right of access, rectification, erasure, restriction, objection and portability of their data. To exercise these rights, contact: privacy@airproxy.cloud

Data is not sold to third parties. It may be passed on to subcontractors (hosting, payment) in compliance with the GDPR.

Amendment and termination

Amendment of the Terms: Airproxy reserves the right to amend these Terms at any time. Amendments take effect as soon as they are published on the Platform. Users will be informed by email of substantial changes. Continued use of the service constitutes acceptance of the new terms.

Termination by the user: The user may terminate their account at any time by contacting support. Termination does not give rise to a refund of the remaining balance unless otherwise provided for in the Terms of Sale.

Termination by Airproxy: Airproxy reserves the right to suspend or delete an account in the event of a breach of these Terms, fraudulent behavior or non-payment, without notice or compensation.

Governing law and disputes

These Terms are governed by French law. In the event of a dispute relating to their interpretation or performance, the parties undertake to seek an amicable solution within thirty (30) days of notification of the dispute.

Failing an amicable agreement, any dispute shall be submitted to the exclusive jurisdiction of the competent courts of Paris, unless a mandatory provision states otherwise.
