Scope

These Terms of Sale (hereinafter the "Terms") apply to all sales of proxy services made by Airproxy via the airproxy.store Platform, except for elements expressly derogating from these Terms.

These Terms, together with the Terms of Use, constitute the entire agreement between the buyer and Airproxy. They prevail over any other general or specific terms not expressly agreed to by Airproxy.

By placing an order, the buyer acknowledges having read and accepted these Terms without reservation.

Products and services

Airproxy provides residential and datacenter proxies in several countries (France, Spain, Chile, and other destinations available on the Platform). Proxies are digital services allowing access to the internet through dedicated third-party IP addresses.

Each proxy is supplied with the following characteristics:

  • Protocol: HTTP/HTTPS (unless otherwise stated);
  • Authentication: by username/password;
  • Duration: defined at the time of purchase (7, 14, 30 days, etc.);
  • Country: chosen when ordering;
  • Quantity: number of IP addresses ordered.

The exact characteristics (bandwidth, number of concurrent threads, etc.) are specified on the Platform at the time of purchase. Airproxy reserves the right to modify its product catalog without notice.

Prices and VAT

The prices displayed on the Platform are expressed in euros (€). They are shown excluding tax or including all taxes, as explicitly indicated on the order page.

The prices displayed are subject to change. The applicable price is the one in effect at the time the order is confirmed.

Processing fees may apply depending on the payment method chosen (e.g. bank card processing fee). These fees are clearly indicated before payment is confirmed.

Airproxy reserves the right to change its prices at any time. Orders already confirmed are not affected by a subsequent price change.

Orders

The ordering process is as follows:

  1. Selection of the country, quantity and duration of the proxies;
  2. Choice of payment method (Airproxy balance, bank card or cryptocurrency);
  3. Review of the summary and confirmation of the order;
  4. Payment confirmation;
  5. Automatic delivery of proxy access.

The order is definitively confirmed upon receipt of payment. A confirmation email summarizing the order details is sent to the email address associated with the account.

Airproxy reserves the right to cancel any order in the event of suspected fraud, an obvious pricing error or unforeseeable stock shortage. In the event of cancellation at Airproxy's initiative, a full refund will be issued.

Payment

The accepted payment methods are:

  • Airproxy balance: credit previously loaded onto the user account;
  • Bank card (Visa, Mastercard) via the secure payment provider Stripe;
  • Cryptocurrencies (Bitcoin, Ethereum, USDT, etc.) via the payment processor BlockBee.

Card payments are processed securely by Stripe (PCI-DSS certified). Airproxy never stores its users' bank card data.

For cryptocurrency payments, conversion into euros is carried out at the rate in effect at the time the payment is received. Blockchain confirmation delays may apply.

Balance top-up fees: Topping up the Airproxy balance by bank card is subject to a processing fee of €0.50 per transaction, regardless of the amount topped up. These fees are clearly displayed before confirmation.

In the event of non-payment or abusive payment dispute (unjustified chargeback), Airproxy reserves the right to suspend the account concerned and initiate the appropriate recovery procedures.

Delivery and activation
Instant delivery. Proxy access is activated and delivered automatically after payment confirmation. It is accessible from the "My account" area on the Platform.

Delivery takes place in digital form (host, port, username, password). Access can be viewed and exported from the user interface at any time during the validity period.

In the event of a technical problem delaying delivery beyond 5 minutes after payment, the user is invited to contact support via the ticket system. Airproxy undertakes to resolve any incident within a reasonable time or to issue a refund.

As delivery is carried out electronically, no shipping fees apply.

Right of withdrawal
No right of withdrawal. In accordance with Article L.221-28 13° of the French Consumer Code, the right of withdrawal does not apply to digital content whose performance has begun with the consumer's prior consent, the consumer having expressly waived their right of withdrawal.

By confirming their order, the user expressly acknowledges that:

  • They wish to benefit from the immediate performance of the digital service;
  • They expressly waive their 14-day right of withdrawal as soon as the proxies are delivered;
  • No refund may be requested once the proxy access has been activated and delivered.

This waiver is collected when the order is confirmed, in accordance with legal requirements. An explicit confirmation checkbox is presented before any purchase.

However, in the event of proven non-delivery or obvious non-conformity of the service, Airproxy undertakes to offer a replacement solution or a refund as a goodwill gesture.

Duration and renewal

Each proxy is sold for a fixed duration, indicated when ordering and on the invoice. The duration begins to run from the date of effective activation of the proxy.

Proxies are not subject to automatic renewal. Upon expiry of the subscribed period, access to the proxy is automatically deactivated. The user may purchase new proxies at any time.

No refund will be granted for the unused duration of a still-valid proxy, except in the event of a proven technical failure attributable to Airproxy.

Warranties and claims

Airproxy guarantees that the services supplied conform to their description on the Platform at the time of purchase. In the event of proven non-conformity (proxy non-functional on delivery, wrong country, etc.), the user has 48 hours from delivery to report it via support.

In the event of a justified claim, Airproxy will offer, at its choice:

  • Replacement of the faulty proxy with an equivalent proxy;
  • A credit to the Airproxy balance corresponding to the value of the faulty proxy;
  • A refund in cases of proven non-delivery.

Any claim must be submitted via the ticket system available in the "My account" area, specifying the order ID and the nature of the problem.

Airproxy is not responsible for service interruptions due to third-party decisions (IP blocking by a target site, access provider maintenance, etc.).

Balance and top-up

The Airproxy balance is prepaid credit usable for the purchase of proxies on the Platform. It is not refundable in cash except by exceptional decision of Airproxy.

The balance is not subject to an expiry date as long as the account remains active. In the event of account closure for violation of the Terms of Use/Terms of Sale, the remaining balance is permanently lost without compensation.

No minimum top-up amount is imposed. The maximum amount per transaction is €500.00.

Top-up by bank card incurs a processing fee of €0.50 per transaction (see Article 5). Top-up by cryptocurrency does not incur Airproxy fees, but blockchain network fees may apply.

Invoicing

An electronic invoice is automatically generated for each purchase of proxies. It is available in the "Invoices" section of the "My account" area and can be downloaded in PDF format.

The invoice notably states:

  • The unique invoice number (format AIR-YYYYMMDD-XXXX);
  • The date of purchase;
  • The service description (country, quantity, duration);
  • The total amount paid and the currency;
  • The payment method used.

Invoices are archived and accessible indefinitely from the user area. If you lose access to your account, contact support to retrieve your invoices.

Force majeure

Airproxy cannot be held liable for the non-performance or delay in the performance of its obligations in the event of a force majeure event within the meaning of Article 1218 of the French Civil Code, in particular:

  • Natural disasters, epidemics, acts of war or terrorism;
  • Widespread network or internet infrastructure outages;
  • Government or regulatory decisions making it impossible to provide the service;
  • Large-scale cyberattacks affecting the infrastructure of Airproxy or its suppliers.

In the event of force majeure, Airproxy will inform users as soon as possible and will endeavor to resume the service as quickly as possible. If the interruption exceeds thirty (30) days, users may request a refund prorated to the unused duration.

Governing law and disputes

These Terms are governed by French law. Any dispute relating to their interpretation, validity or performance shall be submitted to the jurisdiction of the competent courts, subject to the mandatory provisions protecting consumers.

Mediation: In the event of a dispute, the user may use, free of charge, an approved consumer mediator before any legal action. Contact details available on request at legal@airproxy.cloud
